Terms of use

Introduction

For reasons of simplification  we may refer to contract party A (the service provider); Egert & Kölbel GmbH as "we", "us" or "translate.IT"  and to contract party B (the service recipient) as "you" or "consumer" .

The purchase contract shall be concluded with Egert & Kölbel GmbH (Tradename: translate.IT)

Definition of Services

translate.IT offers two main types of services: translation and transcreation, each consiting of specific sub services. If not specifically agreed upon differently in written form, we will process translation projects applying the following sub services by default:

Project management , machine translation, machine translation post editing, proof reading, human translation, human translation post editing and quality assurance. 
By nature transcreation projects are more dynamic. We will not start working on a project, before we have concluded a service roadmap and budget with you.

Payment

By default we request a full prepayment from private customers and reserve the right to request full or partial prepayments from any commercial customer we are unfamiliar with.
Upon conclusion of a work order, we will provide you with a link to our payment gateway. You can settle your balance via: PayPal, direct debit or credit card.

SCOPE

These General Terms and Conditions (GTC) shall apply to all deliveries made by Egert & Kölbel GmbH (Trade name: translate.IT ) to consumers (§ 13 BGB).

A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

OFFER AND CONCLUSION OF CONTRACT

3.1 The indication of prices on our website do not constitute a legally binding offer, but serve as a resource for price estimation. 

3.2 By accepting an offer, you enter into a legally binding contract with us.

3.3 You can request the annulation of the contract up until 14 days after its conclusion, but we are not obliged to grant this request at no cost.
3.4 If you request the annulation of the service contract at a time when we have already started to execute the service, we may charge you for those services executed but at least 50% of the total project volume. 3.5 If you request the annulation of the service contract, at a time when we have not yet initiated the translation or transcreation process, we may still charge a 100€ fee for projectmanagement (even if this position has not been indicated in the original offer) plus a 10% penalty fee of the total project volume.

Conclusion

These general terms of service hold validity over any verbal communication. 

Only explicit written annulment, project specific contracts or framework contracts can supersede our general terms of service
